Pet Anthemz — Terms of Service

By using PetAnthemz.com ("Pet Anthemz," "we," "us") and purchasing or generating any song, video, or related product, you ("you," "the user") agree to these Terms of Service. If you do not agree, do not use the service.
1. The Service
Pet Anthemz uses artificial intelligence to generate custom songs, lyrics, and videos based on information and images you provide. Each song generation produces two AI-created tracks. You must be at least 18 years old to make a purchase.
2. No Refunds
All sales are final. Because songs and videos are custom-generated digital products created specifically for you, we do not offer refunds, returns, or cancellations once a purchase is made. You are able to preview every song with a watermark before purchasing, so you know what you are buying.
If you are dissatisfied with a generated song, our sole remedy is to provide you with additional free song generations at our discretion. We do not provide cash refunds.
3. Chargebacks
Initiating a payment dispute or chargeback after a song or product has been delivered is a violation of these Terms. Because you preview your song before purchase and all sales are final, we will contest chargebacks and may provide your purchase and usage records to the payment processor.
4. Song Storage and Availability
We will keep your purchased song available for download on PetAnthemz.com for at least one (1) year from the date of purchase. This ensures that, if we ever need to discontinue the service, you have adequate time to download and save your song.
After one year, we may delete your song from our servers without further notice. You are responsible for downloading and keeping your own copy of any song you purchase. We are not liable for any song that becomes unavailable after this period or due to circumstances beyond our control.
Free, watermarked previews are deleted two (2) hours after they are first played. Unpurchased previews are not stored and cannot be recovered.
5. Your Rights to Your Song
Once you purchase a song, you have full and unrestricted rights to use it as you wish, for personal or commercial purposes.
You acknowledge that songs are generated by artificial intelligence. We do not guarantee that any song is eligible for copyright protection, nor do we warrant that it is wholly original or free of similarity to other works. Your rights consist of the license and access we grant you under these Terms.
6. Our Rights to Reference Songs
Pet Anthemz retains the right to reference and showcase songs we have created as examples of our work and portfolio.
We will not use your song, your pet's images, or any content you provide in Pet Anthemz marketing, advertising, or promotional materials without first obtaining your consent.
7. Photos and Content You Provide
When you upload photos or submit text for a song or video, you confirm that you own or have permission to use that content, and that it does not infringe anyone's rights. You grant us a limited license to process your content solely to generate and deliver your song and video.
You agree not to submit content that is illegal, offensive, infringing, or that depicts identifiable people (other than yourself) without their consent. Pet Anthemz is intended for songs about pets. We may refuse, remove, or decline to process any submission at our discretion.
8. Streaming Distribution (Optional Upsell)
If you purchase streaming distribution, your song will be published to Spotify, Apple Music, and similar platforms as part of a Pet Anthemz album through a third-party distributor. You understand that publication and any later removal are subject to those platforms' and the distributor's timelines and policies, which we do not control, and that your song will appear alongside other songs on a shared album.
9. Physical Products (NFC Stickers)
If you purchase an NFC sticker, the no-refund policy applies. If your sticker arrives defective or does not arrive, contact us and we will arrange a replacement.
10. Service Availability and AI Limitations
Pet Anthemz relies on third-party services for song generation, video rendering, distribution, payments, and email. We do not guarantee uninterrupted service, specific generation times, or that any song or video will meet your expectations. Generation times shown on the site are estimates.
Song and video delivery depends on the email address you provide. We are not responsible for songs that are not received because of an incorrect or inaccessible email address.
11. Disclaimer and Limitation of Liability
The service is provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, Pet Anthemz's total liability for any claim arising from the service is limited to the amount you paid for the product giving rise to the claim.
12. Changes to These Terms
We may update these Terms at any time. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of [Virginia / your state of incorporation], and any dispute will be resolved in the courts located there.

15. Phone Number and Text Messages
We may ask for your phone number so we can text you when your song is ready and send you other messages directly related to your order. By providing your phone number, you consent to receive these transactional text messages.
We will not send you marketing or promotional text messages unless you separately opt in to receive them. If you do opt in, you can withdraw your consent at any time by replying STOP to any marketing text. Standard message and data rates may apply.
